This Terms and Conditions Agreement (“Agreement”) is between you (“You” or “Customer” or “Client”) and Grayson Wallen (hereafter mentioned as “Grayson”). By using the material or making a purchase from this website, you expressly agree to be bound, without modification, to this Agreement. If you do not agree to be bound to this Agreement, you cannot make a purchase on this website and/or join any of Grayson’s offerings.
AMENDMENTS and CHANGES
If Grayson sends you a revised version of this Agreement at the email address you provided upon purchase or subscription, you automatically become bound by the latest version of the Agreement unless you withdraw in writing from the program. To withdraw, please email Grayson at: Grayson@GraysonWallen.com. You have an affirmative duty to notify Grayson of any changes to your email address, and to review any changes to the Agreement.
Private Session Policies
No shows, cancelations, or rescheduling done less than forty-eight (48) hours before your session will result in your session being forfeited and you will be reliable for your full session fee.
Private Session Confidentiality
Grayson regards any information provided by you to be confidential. Grayson will only reveal such information with your express permission, or as required by law to the appropriate personnel. Confidential information does not include information that is publicly available, that has been disclosed to a third party by you, or that was previously or independently derived by Grayson.
Intellectual Property
Grayson owns the copyrights and other intellectual property rights over any materials provided (including blog posts and free downloads) to you under this Agreement. You are granted a non-transferable, non-assignable, non-exclusive license to use such materials only for your own personal, private use. If you would like to share the resources obtained from this site, please contact Grayson to get permission in writing at: Grayson@GraysonWallen.com.
From time to time, there may be information on this website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. Grayson reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted an order). If you do not wish to continue with your order after placing or other information has been corrected, please contact us right away and I will work with you to cancel or return your order so long as your order has not already shipped.
No Assignment or Transfer
You may not assign or transfer this Agreement (including the license you receive under this Agreement) to any other person or entity.
No Refunds
If you make a purchase from this site (for materials or group admittance), you agree and certify that you have reviewed all information in Terms and Conditions carefully and fully understand the terms of this Agreement, what is and is not included, and that there are no refunds. You understand and agree that upon purchase, you are responsible for full payment, regardless of whether you have selected the lump sum payment or an installment plan.
No Guarantees
Grayson cannot and does not guarantee that any specific results will be obtained from the information provided on this site, because specific results involve factors beyond the control of Grayson and/or the scope of counseling. If you have any questions about programs and/or resources offered, please contact Grayson before making a purchase.
Disclosure
Grayson is not providing mental health services or therapy through the programs and/or resources provided under this Agreement. You should seek medical advice for any medical or mental health problems, and you have the responsibility to consult with a medical professional regarding any medical conditions. Legal Terms
The terms of this Agreement cannot be waived or modified except by an express agreement in writing signed by all of the parties. This Agreement constitutes the entire agreement between you and Grayson and supersedes all prior or contemporaneous written or oral agreements between us with respect to the subject matter contained in this Agreement. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remainder of this Agreement shall not in any way be affected or impaired. This Agreement shall be governed by and construed under the laws of the State of California, California Board of Behavioral Sciences and the American Counseling Association Code of Ethics. Any and all disputes or claims arising out of or relating to this Agreement shall exclusively be brought and heard in San Diego County, California, and both parties consent to jurisdiction in San Diego County, California.
Compliance with COPPA
The Site is not directed at children under the age of 13. Grayson complies with the Children’s Online Privacy Protection Act and does not knowingly permit submission of Personal Information by anyone under 13 years of age.
HIPAA
At the beginning of therapy, U.S. Federal HIPAA law requires that your independently practicing clinician present you with a notice of privacy policies similar to that presented in this document. Please be sure that you receive and sign such a document prior to proceeding with therapy or counseling.
